Terms and Conditions of Luminara Studios

1. Acceptance of Terms

By accessing and using the Luminara Studios website and/or booking our studio space, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Definitions

• "Luminara Studios", "We", "Us", or "Our" refers to the owner and operator of the photo studio.
• "You" or "Client" refers to the individual, company, or entity booking and using our studio facilities.
• "Studio" refers to the physical premises and equipment provided by Luminara Studios for rental.
• "Booking" refers to the confirmed reservation of the Studio for a specific date and time.
• "Services" refer to the rental of the Studio, its equipment, and any additional services offered by Luminara Studios.

3. Studio Rental and Usage

3.1 Booking Procedure

All bookings are subject to availability. You can request a booking through our website or by contacting us directly. A booking is considered confirmed only after written confirmation from Luminara Studios and receipt of any required deposit.

3.2 Studio Access and Hours

Studio access is granted only during the booked hours. Late arrivals or early departures do not entitle you to an extension of your rental period. Please adhere strictly to your booked time slot to avoid overlapping with other clients.

3.3 Permitted Use

The Studio is intended for professional photography, videography, and related creative activities. Any use of the Studio for illegal activities, or activities that may cause damage to the property or disturbance to neighbors, is strictly prohibited. The Studio reserves the right to refuse service to anyone or to terminate a booking if these terms are violated.

3.4 Client Responsibilities

• The Client is responsible for the conduct of themselves and their guests/assistants during the rental period.
• The Client must ensure that all equipment used is operated safely and in accordance with manufacturer instructions.
• The Client must leave the Studio in the same condition as it was found, free of debris, personal belongings, and excessive mess.
• Smoking is strictly prohibited inside the Studio. Designated smoking areas, if available, must be used.
• Pets are generally not permitted without prior written consent from Luminara Studios.
• The use of open flames, pyrotechnics, or any hazardous materials is strictly forbidden unless express written permission is obtained from Luminara Studios and appropriate safety measures are in place.

3.5 Studio Equipment

All equipment provided by Luminara Studios is for use within the Studio premises only. The Client is responsible for any damage or loss of equipment due to negligence or misuse during their booking. A fee may be charged for the repair or replacement of damaged or lost equipment.

4. Payment and Fees

4.1 Rental Rates

Rental rates are published on our website and are subject to change without notice. The rate applicable at the time of booking confirmation will apply.

4.2 Deposits and Final Payment

A non-refundable deposit may be required to secure your booking. The remaining balance is due on or before the date of your rental, as specified by Luminara Studios. Failure to make timely payments may result in cancellation of your booking.

4.3 Additional Charges

Additional charges may apply for excessive cleaning, damage to the Studio or equipment, overtime usage beyond the booked period, or any special requests not included in the standard rental package.

5. Cancellation and Rescheduling Policy

We understand that plans can change. Our cancellation policy is as follows:

• Cancellations by Client:
  • More than 7 days before the booking date: Full refund of the rental fee, minus the non-refundable deposit.
  • Between 3 and 7 days before the booking date: 50% refund of the rental fee.
  • Less than 3 days before the booking date: No refund will be issued.
• Rescheduling by Client: Requests to reschedule a booking are subject to availability and must be made at least 7 days prior to the original booking date. A rescheduling fee may apply.
• Cancellations by Luminara Studios: In the unlikely event that Luminara Studios needs to cancel a booking due to unforeseen circumstances (e.g., equipment failure, necessary maintenance), we will provide a full refund of all payments made or offer an alternative date at no additional cost, at our discretion.

6. Intellectual Property and Content

Luminara Studios does not claim ownership of any intellectual property rights in the content created by the Client during their studio rental. However, by using our facilities, you grant Luminara Studios the right to use any images or videos taken in the studio for marketing and promotional purposes on our website, social media, and other marketing materials, unless otherwise agreed in writing.

7. Liability and Indemnification

7.1 Limitation of Liability

Luminara Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Studio or Services. We are not responsible for the loss or damage of personal property brought into the Studio.

7.2 Indemnification

You agree to indemnify and hold harmless Luminara Studios, its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that may arise from your violation of this Agreement, your use of the Studio or its equipment, or your violation of any rights of another.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be settled through negotiation. If an agreement cannot be reached, the dispute shall be submitted to the competent courts of the Russian Federation.

9. Modifications to Terms

Luminara Studios reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes your acceptance of the new terms.
